According to witnesses for the Peoples Democratic Party (PDP) and Atiku Abubakar, the party’s presidential candidate, Bola Tinubu is unable to be sworn in as president since he did not achieve a score of 25% in the FCT.
The witnesses argued that it is lawful for a candidate to receive 25% of the vote in the FCT in order to be declared the winner during the resumed hearing on Atiku’s case against Tinubu.
On Monday, the following witnesses gave testimony: Abiye Sekibo (Rivers), Abraham David (FCT), Mohammed Babaji Madaki (FCT), and Ibrahim Mohammed Hamza (Nasarawa).
The PDP chairman for the FCT, Madaki, testified through PDP counsel Eyitayo Jegede (SAN), claiming that obtaining a score of 25 percent in the FCT was necessary to be elected president.
Remember that only Peter Obi, the Labour Party candidate, received 25 percent or more of the votes in the FCT, receiving 281,717 votes, or 59 percent, in the results of the presidential election issued by the Independent National Electoral Commission (INEC).
Atiku Abubakar received 74,194 votes, whereas Tinubu of the All Progressives Congress received the maximum number of votes (8,794,726) but just 90,902, or 18.98%, of the votes cast in the Federal Capital Territory.
Abdullahi Aliyu, counsel for the Independent National Electoral Commission (INEC), cross-examined him, and he insisted that his testimony was based on the law and the constitution rather than on his own view.
When asked if his candidate received the necessary outcome in the FCT, he responded, “My candidate did not score 25% of votes in the FCT based on the purported result published by INEC.”
Madaki acknowledged that the FCT is similar to other states when being cross-examined by Lateef Fagbemi (SAN), counsel for the APC.
When INEC counsel Aliyu questioned David, the PDP FCT collation agent, about whether Atiku, who received just 15% of the vote rather than the required 25%, was fit to be named president, David responded, “I agree he (Atiku) is not entitled to be declared as president, even Tinubu.”
