Onjeh challenges Moro’s victory in court on four separate grounds

On Thursday, Comrade Daniel Onjeh, candidate for the Senate seat in the Benue South constituency for the All Progressives Congress (APC), 2023, filed an appeal with the Appeal Court in Makurdi, challenging the decision of the National and State Assembly Elections Petition Tribunal, which upheld Sen. Patrick Abba Moro of the Peoples Democratic Party (PDP) in the 2023 election.

On September 10, 2018, a three-judge panel of the Tribunal in Makurdi, Benue State, presided over by the Hon. Justice Ory Zik-Ikeoha, denied Onjeh’s petition.

Senator Abba Moro, the PDP, and the INEC were all included as respondents in Onjeh’s petition.

The three-person Tribunal panel concluded that the petitioners did not provide sufficient evidence to support their claims that Moro was not qualified to serve as a senator, that he was not elected with a majority of the lawful votes cast, or that the election on February 25, 2023 was conducted in violation of the Electoral Act, 2022.

However, Onjeh quickly responded, saying that the case was far from finished and that his attorneys were still reviewing the Tribunal’s decision and will provide advice on his next steps.

On Thursday, he challenged the Tribunal’s rulings in a four-page Notice of Appeal filed with the Court of Appeal, Makurdi Judicial Division.

By upholding Sen. Moro’s victory in the 25th February, 2023 polls, the Election Petition Tribunal, according to the former Chairman of the Governing Board of the Projects Development Institute (PRODA), Enugu’s legal team led by Mr. Adetunji Oso, caused a grave miscarriage of justice.

Therefore, Onjeh is requesting that the Appeal Court reverse the return and declaration of the 1st Respondent and instead declare him to have received the legitimate majority of votes cast in the election.
